Master Photography Services Terms

1. Scope and deliverables. The selected package, written proposal, invoice, and approved change orders define coverage time, locations, image quantities, products, delivery estimates, and permitted use.
2. Reservation and payment. A date is not reserved until the required retainer and signed agreement are received. Remaining balances are due as stated on the invoice. Orders may be paused while a balance is overdue.
3. Cancellation and rescheduling. Retainers compensate LENS for reserving time and preparation. Any refund, transfer, rescheduling fee, weather exception, or cancellation deadline will be stated in the final booking summary and must comply with applicable law.
4. Creative discretion. Client has reviewed Tony Huber's style and grants reasonable discretion over lighting, posing, composition, editing, and image selection. Specific images are planned in good faith but cannot be guaranteed when circumstances are outside reasonable control.
5. Client responsibilities. Client will arrive prepared, obtain required permissions, identify must-have people and moments, and disclose material safety, accessibility, timing, venue, or usage requirements.
6. Copyright and license. LENS retains copyright unless a separate signed document expressly transfers it. The client receives only the personal or commercial license stated in the booking documents. Unapproved resale, sublicensing, filters, substantial alteration, or removal of authorship information is prohibited.
7. Portfolio use. Promotional use is optional and separately selected below. Declining it does not change service or price.
8. Delivery and archiving. Delivery estimates begin after the session and final payment. Online galleries and backups are maintained for the stated period; clients are responsible for timely downloads and backups.
9. Prints and color. Professional products ordered through the connected gallery are fulfilled under the posted store terms. LENS cannot guarantee color or quality from unauthorized consumer labs.
10. Safety and force majeure. LENS may stop or modify work for unsafe, unlawful, threatening, inaccessible, or damaging conditions. Neither party is responsible for delay caused by events beyond reasonable control; the parties will pursue a fair reschedule or substitute performance.
11. Liability. To the extent permitted by law, any liability will be limited by the signed agreement and applicable consumer law. Nothing here waives a right that cannot legally be waived.
12. Missouri law and entire agreement. Missouri law governs. The signed agreement, selected addendum, proposal, invoice, and written changes form the agreement. Electronic records and signatures are intended to have legal effect.
